Alimony

Vienna Alimony Attorneys

Results-Driven Representation Focused On You

Alimony, also known as spousal support, is a court-ordered financial obligation one spouse must pay the other spouse after a divorce. Alimony is intended to help the recipient spouse maintain the marital standard of living during the transition out of the marriage, and can be temporary or permanent.

Some of the factors that a judge may consider when deciding whether to award alimony include:

  • The length of the marriage
  • The standard of living during the marriage
  • The financial circumstances of each spouse
  • Each spouse’s contributions to the marriage
  • The age and health of the separating couple
  • Whether either spouse has committed an act of adultery

If you are facing a divorce in Fairfax County, you might be uncertain about whether you are eligible for alimony, how much you might receive, or how long you will have to pay it.

How Long Does Alimony Last in Virginia?

Alimony can be temporary or permanent, with temporary alimony lasting for a limited time and permanent alimony lasting indefinitely. In Virginia, permanent alimony is granted in only a few circumstances, such as when one spouse lacks the ability to become self-supporting because of a physical or mental disability.

Temporary alimony may be awarded for a few years or for a few decades, depending on the circumstances. If a couple was married for more than ten years, the court may award permanent alimony to the spouse who needs support. As noted above, permanent alimony is awarded in limited circumstances. In most cases, temporary alimony will last for three to five years.
